Section 9.7. Board of review; composition; members; appointment; compensation.

The board of review shall be composed of three freeholders who are qualified and registered electors of the city who during their term of office shall not be city officers or employees or be nominees or candidates for elective city office The filing by a member of the board of review of his nomination petition for an elective city office or the filing of a consent thereto shall constitute a resignation from the board of review. One member of the board shall be appointed by the council annually in January, 1968, and each year thereafter for a term of three (3) years, to replace the member whose term expires that year. The council shall fix the compensation of the members of the board.

The board of review shall annually in February select its own chairman for the ensuing year, and the assessor shall be clerk of the board and shall be entitled to be heard at its sessions. A majority of the members of the board shall constitute a quorum.

Section 9.9. Same; notice of meetings required.

The council shall provide for giving notice to the public of the time and place of the meeting of the board of review. Such notice shall be given not less than ten days before the convening of the board and as often thereafter as the council deems fit.

12.1. Purchasing department; ordinance required; purchases, sales, regulations.

The council may create by ordinance a purchasing department, and until such adoption the mayor shall designate an administrative officer of the city in charge of purchasing who shall be known as the purchasing officer, who shall be responsible for the purchase and sale of all city property, and shall also be responsible for the procurement, storage and distribution of all city supplies and equipment. 

12.2.  Contracts; council authority; general provisions.  

The authority to contract on behalf of the city is vested in the council, and shall be exercised in accordance with the provisions of statue and of this charter, provided that purchases and sales be made by the purchasing officer subject to the provisions of section 12.1.  

Any contract or agreement in an amount of one thousand dollars or more made with form or terms other than the standard city purchase order form, shall before execution be submitted to the attorney and his opinion obtained with respect to its form and legality.  A copy of all contracts or agreements requiring such opinion shall be filed in the office of the clerk together with a copy of the opinion. **  

Section 12.3.  Public property; sales, leases; requisites, restrictions

Any agreement or contract for the renting or letting of public property for a period longer than three years shall be subject to the same referendum procedure as provided in the case of ordinances passed by the council.  However, a summary of the terms of any such agreement or contract shall be published within ten days after its approval by the council and any petition for such referendum must be filed within thirty days after such publication to be effective.  

The transfer or assignment of any agreement or contract for the renting or letting of public property may be made only upon approval of the council, but approval of such transfer shall not be subject to referendum.  

Rentals and leases and renewals thereof shall be for a fair consideration as determined by the council.  

The city shall not sell any park, cemetery or part thereof, except where such park is not required under an official master plan of the city, unless approved by three-fifths of the electors voting thereon at any general or special election.  

Section 12.4.  Repudiation of debts prohibited.  

The city shall not repudiate any debt by any change in its charter or by consolidation with any other municipality.

Section 14.1. Prior franchises continued.

All franchises to which the Village of Milan is a party when this charter becomes effective, shall remain in full force and effect in accordance with their respective terms and conditions.

Section 15.1. City representatives, number, state law.

The city shall have the maximum number of representatives on each county board of supervisors to which it is entitled by statute.

Section 18.1. Status of schedule chapter.

The purpose of this schedule chapter is to inaugurate the government of the city under this charter and to accomplish the transition from village to city government, and it shall constitute a part of this charter only to the extent and for the time required to accomplish this end.
