BANKRUPTCY
CHAPTER 7 and 13
Will Bankruptcy help me?
By Martha A. Churchill, Attorney at Law
In deciding whether to file for Bankruptcy, it is important to look calmly at your financial situation. The US Bankruptcy laws are there to help when a person is deeply "under water."
Filing the bankruptcy petition gives instant "relief"
from creditors. Credit card companies, collections agents, and other creditors
must stop calling or writing you, and stop asking for payment, the moment you file. Under Chapter 7, the whole process takes only a few months or so, and at the end, you lose all those old debts forever.
Here are some tips if you are thinking about Bankruptcy:
1. Don't pay back debts to family members or friends without consulting an attorney.
2. Don't take money out of your retirement plan to pay creditors until you have talked to a Bankrutpcy Attorney.
3. Don't enter into a hopeless plan to pay back creditors, when you are not left with enough money to buy groceries.
4. If you are facing a possible home foreclosure or if your car may be repossessed, talk to an attorney.
